Design My Case (DMC) – Terms & Conditions

1. Introduction

These Terms & Conditions govern your use of Design My Case (“DMC”, “we”, “us”, “our”) and any purchases made via designmycase.co.uk.

By accessing our website or placing an order, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree, you must not use our website or services.

These terms are governed by and interpreted in accordance with the laws of England and Wales.

 

2. Our Service

Design My Case provides made-to-order, personalised phone cases created using designs, images, and selections supplied by the customer.

Each product is individually produced and tailored to the specifications selected at checkout. As such, every item is unique and cannot be resold.

 

3. Placing an Order

3.1 A legally binding contract is formed once your order has been accepted and confirmed via email.

3.2 You are responsible for reviewing your order in full before completing checkout, including:

  • Phone model selection
  • Design and uploaded content
  • Delivery details

3.3 Once production has started, orders cannot be amended, cancelled, or refunded except where required by law.

3.4 We reserve the right to refuse or cancel any order at our discretion, including but not limited to:

  • Suspected fraudulent activity
  • Incorrect pricing or system errors
  • Incomplete or unverifiable customer information

4. Nature of Personalised Products

4.1 All products sold by DMC are custom-made to your individual specifications.

4.2 Under the Consumer Contracts Regulations 2013, personalised goods are exempt from the standard 14-day cancellation (cooling-off) period.

4.3 By placing an order, you acknowledge and accept that:

  • Your item is made specifically for you
  • It cannot be resold or reused
  • It is therefore non-refundable unless faulty or not as described

 

5. Customer Responsibility

5.1 You are solely responsible for ensuring:

  • The correct phone model is selected
  • All text, spelling, and design elements are accurate
  • The delivery address is complete and correct

5.2 We do not accept liability for errors made during the ordering process, including:

  • Incorrect device selection
  • Typographical errors
  • Design placement or content choices

5.3 Orders sent to incorrect addresses provided by the customer will not be replaced or refunded.

 

6. Image Uploads & User Content

6.1 By uploading images, text, or other content (“Content”), you confirm that:

  • You own the rights to the content, or have permission to use it
  • The content does not infringe any copyright, trademark, or third-party rights
  • The content complies with applicable laws and regulations

6.2 You grant DMC a non-exclusive, limited licence to use the content solely for:

  • Producing your order
  • Providing customer service

6.3 We reserve the right to reject or cancel orders containing content that is:

  • Offensive, unlawful, or inappropriate
  • Technically unsuitable for printing

6.4 Uploaded content may be automatically deleted from our systems after a reasonable period for data management purposes.

 

7. Print Quality & Image Limitations

7.1 The final printed product is dependent on the quality of the image provided by the customer.

7.2 We are not responsible for issues arising from:

  • Low-resolution uploads
  • Pixelation or blurring
  • Compression artefacts
  • Poor lighting or image clarity

7.3 By placing an order, you accept that print output may differ from on-screen previews due to technical limitations.

 

8. Colour Representation & Display Variations

8.1 Colours displayed on screens may vary depending on:

  • Device type
  • Screen calibration
  • Brightness and display settings

8.2 Website previews are digital representations and may include visual enhancements such as:

  • Lighting effects
  • Shadows
  • Reflections

8.3 These previews are intended as a guide only.

8.4 Minor colour variations between the preview and final product are normal and do not constitute a defect.

 

9. Compatibility with Third-Party Accessories

9.1 Our cases are designed to fit devices in their original, manufacturer-standard form.

9.2 We do not guarantee compatibility with:

  • Screen protectors
  • Camera lens covers
  • Skins or wraps
  • Magnetic mounts or adhesive accessories

9.3 Any fit issues caused by such accessories are not considered faults and are not eligible for refund or replacement.

 

10. Refunds, Returns & Faults

10.1 Personalised Items

Due to their custom nature, personalised items cannot be returned or refunded unless:

  • Faulty
  • Damaged
  • Not as described

10.2 Customer Errors

We do not accept returns for:

  • Incorrect phone model selected
  • Design or spelling errors
  • Change of mind

10.3 Faulty or Damaged Goods

If your item is faulty or damaged:

  • You must notify us within 14 days of delivery
  • Evidence (such as photographs) may be required

We will offer a suitable remedy in line with your statutory rights, including:

  • Repair
  • Replacement
  • Refund (where applicable)

10.4 Returns Window

All approved returns must be initiated within 30 days of delivery.

 

11. Production, Dispatch & Delivery

11.1 Orders are produced within the timeframe stated at checkout.

11.2 Delivery timeframes are estimates and may vary due to factors outside our control.

11.3 Once dispatched, delivery is handled by third-party carriers such as

Royal mail, My Hermes, DHL

11.4 We are not responsible for delays caused by postal services, weather conditions, or logistical issues.

 

12. Delivery Responsibility

12.1 Orders marked as delivered by the courier are considered fulfilled.

12.2 We are not liable for:

  • Lost or stolen items after delivery
  • Safe place or neighbour deliveries
  • Incorrect addresses provided by the customer

12.3 Any claims regarding non-delivery must be reported promptly.

 

13. Payments & Security

13.1 All payments are processed securely through third-party providers.

13.2 We do not store payment card details.

13.3 We reserve the right to:

  • Cancel high-risk transactions
  • Request additional verification

 

14. Intellectual Property

All content on this website, including designs, branding, and materials, is owned by DMC or its licensors.

You may not reproduce, copy, or distribute any content without permission.

 

15. Limitation of Liability

To the fullest extent permitted by law, DMC shall not be liable for:

  • Indirect or consequential losses
  • Loss of profits or business
  • Issues arising from misuse of products

Nothing in these terms excludes liability for:

  • Death or personal injury
  • Fraud or fraudulent misrepresentation

 

16. Website Use

You agree not to:

  • Misuse the website
  • Interfere with its operation
  • Upload harmful or unlawful content

 

17. Amendments

We reserve the right to update these Terms & Conditions at any time. Continued use of the website constitutes acceptance of any changes.
